These Terms of Service govern access to elavryne.com and purchases from ELAVRYNE. The store is operated by STYLE SURGE LLC. By using the site or placing an order, you agree to these terms and the policies incorporated by reference.
Eligibility and acceptable use
You must be legally capable of entering a binding agreement in your jurisdiction. You may use the store only for lawful personal shopping purposes. You may not interfere with site security, introduce malicious code, scrape the site without permission, impersonate another person, misuse promotions, or use the service to violate law or third-party rights.
Product information
We make reasonable efforts to present product colors, measurements, materials, prices, and availability accurately. Displays and lighting can affect perceived color. Apparel measurements may vary slightly by production batch. Product information may be corrected or updated without notice before an order is accepted.
Orders
An order confirmation acknowledges receipt of your request; it does not guarantee acceptance. We may decline or cancel an order for inventory errors, pricing errors, suspected fraud, payment problems, address limitations, purchase limits, or other legitimate business reasons. If we cancel after payment, we will refund the canceled amount to the original payment method.
Prices taxes and payment
Prices are shown in U.S. dollars unless stated otherwise. Applicable sales tax is calculated during checkout based on the order and delivery address. You authorize us and our payment providers to charge the amount shown at checkout.
Shipping returns and cancellations
Shipping, delivery, returns, refunds, exchanges, and cancellations are governed by the separate Shipping Policy and Return and Refund Policy. Those policies form part of these terms.
Intellectual property
The ELAVRYNE name, site design, product copy, graphics, photographs, and other store content are owned by or licensed to STYLE SURGE LLC and are protected by applicable intellectual-property laws. No license is granted except the limited right to use the site for personal shopping.
Third party services
The store may use or link to third-party services. Their products, availability, and privacy practices are governed by their own terms. We are not responsible for a third-party service outside our control, except where applicable law provides otherwise.
Disclaimers and limitation of liability
To the extent permitted by law, the site and its content are provided on an “as available” basis. We do not exclude warranties or consumer rights that cannot legally be excluded. To the extent permitted by law, STYLE SURGE LLC will not be liable for indirect, incidental, special, or consequential losses arising from use of the site. Any liability that cannot be excluded is limited only to the extent allowed by applicable law.
Indemnification
To the extent permitted by law, you agree to reimburse STYLE SURGE LLC for losses arising from your unlawful misuse of the site or material breach of these terms. This provision does not apply where prohibited by consumer law.
Governing law and disputes
These terms are governed by the laws of the State of Missouri and applicable federal law, without limiting mandatory consumer protections. Before filing a claim, contact support@elavryne.com so the parties can attempt good-faith negotiation and, if appropriate, voluntary mediation. If the matter remains unresolved, either party may pursue available remedies in a court with lawful jurisdiction in Missouri. No mandatory arbitration provision applies.
Changes and contact
